    Westinghouse Co. – 0281

    E. M. Herr, Esq. -2-

Since it has been done I would appreciate it as a favor, if not justice to me, if you will kindly forward me a copy of this report for my instruction and guidance.

When I learned that the Westinghouse Company had entered the wireless field, I took it for granted that they did it with the same spirit and resolve they displayed in other undertakings in which they outdistanced their competitors. The art as now practiced embodies only minor and unessential improvements of detail over my old devices and offers small chances for the exercise of your powers, but I have a system new in all features – transmitters, receivers, static and interference preventers, multiplex apparatus, methods of control, and other particulars. It is a century ahead of the present and would ensure for you undisputed supremacy in a very short time. The whole world is now commited to ridiculously inefficient and expensive installations which will all have to be torn down and reconstructed as soon as my system is put in operation, for the plants will not cost more than ten percent of the present ones and will be ever so much more effective and superior in all commercial respects. Just to mention one of the improvements,I may refer to my basic patent #1,119,732 of Dec.1, 1914, copy of which I gave to Mr. Scott. This invention alone would make it impossible for other wireless concerns to compete with you; moreover, you could accomplish results which are entirely unattainable with the apparatus now in use no matter what capital is spent on it.

The wireless transmission of energy is my life work and I have devoted over twenty-five years to a close theoretical and experimental study of all its phases and possibilities, and feel sure that you could take advantage of a wonderful opportunity. Perhaps it may be practicable to harmonize our views and proceed for the first time being along the path of least resistance if your present policy renders such a course imperative.

Trusting to hear from you at your earliest convenience, I remain

    Very truly yours,

    My dear Mr. Tesla:

I have your letter of the 13th and note what you say in regard to your work in the wireless field. I regret that under present circumstances I cannot proceed further with any development of your activities in this line and am, therefore, compelled to re-affirm my letter of the 11th. I hope that some time in the near future the situation may change and if this transpires, I shall be glad to communicate with you.

    My dear Mr. Herr :

I feel prompted to drop you another line in acknowledgment of your letter of the 16th ult. In which you say again:”Ibis redibis non morieris in bello”. Leaving me in doubt whether the comma precedes or follow 'non'. However, I think my inference is correct, that the Westinghouse Company are not tied up with other concerns.

You will understand, of course, that my interest is merely in an independent development with you. I have the inventions which make the present installments very much out of date and if I can not achieve my ends, with your cooperation, then I must settle upon another course without letting the 'grass grow under my feet'.

    Yours very truly,

      Dear Sir:

Please refer to your letter of the 8th instant addressed to Westinghouse Electric Company.

I have made search through old records and find that the Tesla Electric Light & Manufacturing Company was dissolved July 13, 1889.

Our Company did not own all of the stock of the Tesla Company, but was interested in it through stock ownership. The company was liquidated through Trustees, so presumably each stockholder received an equable share in the settlement.

As the dissolution occurred July 13, 1889, I am unable to trace the connection between any possible claim Mr. Stevens may have had and the transaction which purports to have been undertaken about 14 years ago.

I regret that we are unable to give you a definite information such as you desire.

      Very truly yours,

        Dear Sir:

As you no doubt know, we are operating a radio telephone broadcasting station, featuring concerts, news items, crop and market reports, etc. At our plant here in Newark.

We have been advised by our New York Office, that perhaps you would be willing to speak to our “invisible audience” some Thursday night in the near future. We are making this request of you knowing you to be a very busy man, but feeling that perhaps in order to advance radio activities, you would consent to speak through the air.

These talks usually take place on Thursday evenings at 7 P.M. You might be interested in knowing that Mr. Hiram Percy Maxim is speaking at this plant Thursday, Dec. 1st at 7 P.M.

          My dear Mr. Terry:

Referring to our telephone conversation of even date, I fear that it will not be possible for Mr. Herr, however able a man he may be, to form a definite opinion without much fuller information and it is desirable that I should be given an opportunity for discussing the subject with him and his engineers.

As I have stated to you and Mr. Osborne at our last meeting, I feel absolutely certain that my turbine will defeat by a large margin any other prime mover in commercial competition and will be the mean of saving millions of dollars annually in a dozen different fields. I would not enter in any agreement, no matter how attractive, if it involves a question of any experimenting whatever. What I want is to produce at once marketable apparatus and if the Westinghouse Company will co-operate to this end on some reasonable basis, they only need to indicate what they require. Most of my energies during the past few years have been devoted to the development of these turbines and I am prepared to furnish designs of commercial machines which will operate exactly as specified and be economically superior to any of the existing types.

          Yours very truly.

I learned yesterday from an engineer that the Westinghouse Company are going to erect a broadcasting station in this neighborhood. If you are in the position to give me just an idea of the general character of this plant and of the sum appropriated for its construction, I may be able to make you a very attractive proposition.

A plant embodying certain important inventions and discoveries of mine could be put up in a short time for much less money than the Company is likely to spend and would be sufficient for telephonic broadcasting over the whole world. I am anticipating that a few such plants will be built in the near future in foreign countries.

          Dear Mr. Herr,

When we met the first time I had in mind to propose to the Westinghouse Company the manufacture of a special type of my gas turbine by which considerable savings can be effected in the existing steam-plants. Later, however, I convinced myself that the big undertakings would be delayed unless I formed immediately a powerful alliance. As I feel sure that no other type of prime mover will have the faintest chance in competition with my turbine and that an immense revolution in the production of power is imminent, I am anxious to reach some definite conclusion as soon as possible.

Under separate cover I have mailed you today a statement, of a general character, which I thought useful before discussing the special performances.

          Believe me,

Please accept my thanks for your kind letters of the 10th and 14th instants and the courtesies accorded to me at your office. You are a man after my own heart and I would have been delighted if these inventions of mine had given you an opportunity for the exercise of your genius and energy.

The decision your engineers have reached is most regrettable for I feel quite sure that in a little while they will find themselves in an extremely uncomfortable position. My gas turbine constitutes a revolutionary advance in mechanics and is bound to supersede all other types of prime movers. When I brought out the induction motor I had similar experience. Two great experts declared it to be of trifling value and even when I came to Pittsburgh with my machines I met opposition. Only Mr. Albert Schmidt and Charles F, Scott who assisted me had faith in it, but Mr. Westinghouse's confidence in the ultimate success was always as firm as the rock of Gibraltar.

With renewed thanks and expressions of high regards, I remain

            Dear Mr. Herr,

I am forwarding under enclosure copy of a British patent which I have just received relating to an improvement of great industrial importance. Just to illustrate, in the operation of the 60,000 K.W. unit furnished by you to the Interborough Rapid Transit Co., an installment of my turbine will result in an annual saving of about $300,000. There are approximately 14-1/2 million K. W. In the central plants of the United States and conservatively estimated, - $75,000,000e saved every year in the cost of fuel. Besides, the equipment will be much cheaper and more reliable.

The combination described in the patent is of specific value on vessels of war as well as commerce because of the perfect reversibility of my turbine. In some of the battleship, for instance, there are used two high pressure, two low pressure and two cruising turbines distributed on four shafts, each of which is equipped with a reversing turbine. In such a case, the two high pressure, two cruising and four reversing turbines could be done away with and a saving in the cost of fuel would be approximately fifty percent. Of course, with my gas turbine the results will be much better.

            Yours sincerely,

            Dear Mr. Terry:

Under enclosure find patent specifications relating to my speed indicator and frequency meter, also a copy of letter I received from Mr. Schairer from which it appears that the situation was not fully explained to him.

My company owns the rights under both patents except that we have given to the Waltham Watch Company the exclusive privilege on the first-named invention for the specific use of indicating the translatory speed of a vehicle, and that we have also sold them the right to use the frequency meter on locomotives.

The proposition I made implied of course that you would get full protection under both patents and, if you wanted to manufacture the speed indicator also, we would be glad to include it in the agreement. This, however, would be manifestly out of your line but the frequency meter ...

... is an electrical instrument, there is a great opportunity for it, and I feel sure that if the manufacture is pushed, a business of considerable volume would be built up in a short time. Although the device is popularly called “frequency meter” it is really a speed indicator which is operated through the medium of electrical, instead of mechanical, connections. This is a very big field and almost untouched as the only instrument available now for the purpose is one introduced by the General Electric Company, which is inadequate and very expensive. Mr. Schairer is evidently under the impression that we were offering you merely a limited right under a patent dominated by another one. I hardly need state that we would never contemplate doing business with a concern of the stature of the Westinghouse Company on that kind of a basis.

I am thoroughly familiar with the present situation in this branch of the art and confident that if you will give a trial to this invention you will be gratified with the results. The expense involved is trifling and we could be ready for the market within two months. As we are very anxious to begin the introduction in view of the extraordinary success the Waltham Watch Company is achieving with the speed indicator. I shall be obliged to you for the immediate consideration of this matter.

              Yours very truly,

              Dear Sir:

Since receipt of your letter of March 14th, I have endeavored several times to meet you and explain the situation but was unsuccessful. Accordingly, I have written to Mr. Terry who has just returned from a trip and he will undoubtedly communicate with you.

              Dear Mr. Tesla:

I have your letter of the 30th instant regarding the speed indicator and frequency meter patents.

Mr. Schairer happens to be in my office today and I have gone over the matter with him. While he has understood from his conversation with you and from the letters written by your secretary that the proposed license would be only under the later patent, yet even if both patents were included along the lines indicated in your letter of March 30th, we feel that it would not be advisable for the Westinghouse Company to undertake to manufacture these instruments at this time. The device is in the nature of a specialty, which we believe we cannot well undertake to exploit at present.

Thanking you for having submitted the matter to us, I remain,

              Truly yours,

              Charles A. Terry
              Vice President.

P.S. I am returning herewith copies of the patents which accompanied your letter of the 30th.

              Dear Mr. Tesla:

Pursuant to our conversation a few days ago, I immediately took up the question of your turbine with our Engineers.

I regret to say that I do not find an opinion among them which would warrant our becoming financially interested in the invention.

I have also talked it over with Mr. Terry and Mr. H. T. Herr and they feel as I do, that it is only fair to you to tell you frankly what our position is in order that you may take it up in other directions.

I repeat, I regret that we are unable to take an interest in this turbine development; but, of course, we must be guided by the opinion of our Engineers.

              My dear Mr. Tesla:

I have given careful consideration to the suggestion which you made yesterday and I have come to the conclusion that the Westinghouse Company ought not to enter into the suggested arrangement. I do not believe it would be a satisfactory relationship in view of the position taken by our Engineers.

It is needless to say that I personally regret things have not so shaped themselves that I could feel justified in going further into the matter.

                  Gentlemen:

I have noted with amazement, from a published article with illustrations, that you have adopted essential features of my transmitter, U.S. Patent No. 1,119,732, in the construction of your new Wireless Broadcasting Plant. This invention was offered to you twice, by myself and through Professor C. F. Scott, and your repeated refusal astonished me all the more as the wonderful results attainable by my transmitter must have been known to your engineers. We decided progress in broadcasting will be made until it is generally adopted.

It would be painful to me to have to resort to legal proceedings against a great corporation where business is largely founded on my inventions and I trust that you will recognize the advantage of an amicable understanding.

                  Yours very truly,

                  Gentlemen:

My associates are still awaiting definite reply to our communication of January 29th. It seems to them that a protracted investigation of the subject is unnecessary, in view of what has passed.

Your Mr. Terry is a capable and well informed attorney and the patent files are within his reach. Also, your intelligent technical staff could not have proceeded without an examination of the prior art.

I know that the results with my transmitters will astonish the world, and we are unanimous in our desire to avoid interference with the operation of your plant and cause annoyance to your directors. But if you treat the matter lightly we shall have to resign ourselves regretfully to the only course open to us.

                  New York City

                  Gentlemen:

Replying to your letter of yesterday, it appears that you have lately employed my transmitters, without license, and obtained results by them which have won you the leading position among broadcasters.

In our communication of January 29th reference was made specifically to your plant with an antenna system as outlined in the New York Sun Radio Section of Saturday, January 25th. The circuits shown there are clearly covered by Claim 1 of my patent No. 1,119,732 and also by others, among which may be cited 4 and 6. The curvature of the conductors you employ is sufficient to insure a great resonant rise without appreciable leakage of the charge, and as you have also done away with metallic supports I anticipate that you will achieve an exceptional success. But, surely, you must admit that your infringement of my claims is too palpably evident to be denied. The cage type down-leads mentioned in your letter, unless the capacity elements be arranged as specified in my patent, are one of the worst forms.

I consider that my transmitter offers a simple remedy for statics and interference in general as well as for various other defects impeding the progress of the art, and I am perfectly confident that it will have to be adopted in all transmitting stations.

Our first communication was made in a friendly spirit and in contemplation of the possibility of an amicable understanding which would be greatly to your financial advantage. But unless you meet us promptly in this endeavor we shall have to take steps to protest ourselves.

                  Yours very truly,

                    New York City.

                    Gentlemen:

Supplementary to our letter of June 4, 1930, in regard to which I conferred with your Mr Beam, we beg to call to your attention the following claims of my patent No. 1,119,732 which we offered to you repeatedly in vain prior to your infringement.

                    1. “As a means for producing great electrical activities, a resonant circuit having the outer boundaries, which are charged to a high potential, arranged in surfaces of large radii of curvature so as to prevent leakage of the oscillation charge, substantially as set forth.”

You employ, as a means for producing great electrical activities, a resonant circuit, or circuits, with the outer conducting boundaries, which are charged to a high potential, arranged in surfaces of large radii of curvature (as cylinders and spheres). You thereby prevent the leakage of the oscillating charge and secure the immense advantages of the invention described in the patent.

                    2. “In apparatus for the transmission of electrical energy a circuit connected to ground and to an elevated terminal and having its outer boundaries, which are subject to high tension, arranged, in surfaces of large radii of curvature substantially as, and for the purpose described.”

You use apparatus for the transmission of electrical energy exactly as characterized in this claim and for the purpose ...

... described. It is immaterial whether the connection to the ground is established directly or inductively, as these are well recognized equivalents.

                      4. “As a mean for transmitting electrical energy to a distance through the natural media a grounded resonant circuit, comprising a part upon which the oscillations are impressed and another for raising the tension, having its outer conducting boundaries on which a high tension charge accumulates arranged in surfaces of large radii of curvature, substantially as described.”

This important plan is carried out to the letter in the apparatus you employ for the transmission of electrical energy to a distance through the natural media. You have such resonant circuit, or circuits, each comprising a part upon which oscillations are impressed and another (coil and terminal above) for raising the tension, having its outer conducting boundaries on which a high tension charge accumulates arranged in surfaces of large radii of curvature( cylinders and spheres). The advantages of this form over antennae of ordinary construction, you used before, are enormous.

                      6. “A circuit comprising a part upon which oscillations are impressed and another part for raising the tension by resonance, the latter being supported on places of low electric density and having its outermost conducting boundaries arranged in surfaces of large radii of curvature, as set forth.”

Each of the circuits you employ is literally as described in this claim. Every one of them has a part upon which oscillations are impressed and another for raising the tension by resonance, the latter being supported on places of low electrical density and having its outermost conducting boundaries arranged in surfaces of large radii of curvature (cylinders and spheres). ...

... This is one of my most important inventions as it enables, even with conductors of not more than one or two inches in diameter to produce effects very many times more intense than those obtainable by ordinary antennae, and with far better economy.

                      7. “In apparatus for the transmission of electrical energy without wires a grounded circuit the outer conducting elements of which have a great aggregate area and are arranged in surfaces of large radii of curvature so as to permit the storing of a high charge at a small electrical density and prevent loss through leakage, substantially as described.”

This claim also accurately recites the features of the apparatus you employ for the purpose set forth. In each of the circuits the outer conducting elements have a great aggregate area and are arranged in surfaces of large radii of curvature (cylinders and spheres) so as to permit the storing of a high charge at a small electric density and prevent loss through leakage. In a circuit of this kind a relatively enormous charge can be stored without streamer formation and for this reason as well as others it is tremendously effective. What is still more important, it enables the transmission of almost unlimited amount of power with apparatus of very moderate dimensions and cost.

                      10. “A grounded resonant transmitting circuit having its outer conducting boundaries arranged in surfaces of large radii of curvature in combination with an elevated terminal of great surface supported at points of low electric density, substantially as described.”

You employ exactly this kind of device, namely, a resonant transmitting circuit having its outer conducting boundaries arranged in surfaces of large radii of curvature in combination with an elevated terminal of great surface (cylinder and sphere) supported at points of low electric density.

All these claims read precisely as though they had been ...

... drawn expressly to cover the apparatus you employ. My patent illustrates a transmitter of greater power but embodying the identical features of construction. I think however that you have infringed also other claims of the patent.

We have offered you this revolutionary invention repeatedly, virtually on your own terms and you did not want it. You have preferred to take it by force. You have robbed me of the credit which is my due and injured me and my associates seriously in business. Instead of showing a willingness to adjust this matter with us in an equitable manner, which would involve a relatively small sum of money, you say that you want to fight, expecting probably to delay final decision for years. You reject settlement out of court, even after I suggest it, proposing your Mr. H. Westinghouse as arbiter. You may think that you can secure an advantage by such tactics, but we doubt it, and certainly they will not meet with public approval when all the facts are published.

                      Yours very truly,

                        Dear Mr. Tesla:

Since my visit to you last week, I've been thinking over the many things you told me and have discussed with one of our Research specialists the general proposal of creating rays of the kind you mentioned to me. I found him quite skeptical, so much so in fact that I hesitate to propose Mr. Merrick your suggestion of a six months' advance payment to enable you to file patents.

Would it not be possible to give us some easy steps, in a test way, of some of the principles involved, so we can check them and in that way get confirmation of your theories, so that we “doubting Thomases” could have something more tangible with which to work.

We are giving you information on three ratings of motors: 1,000, 1,250, and 2,000 hp., all 2300 volts, 3 phase, 60 cycle, 3600 r.p.m.. The 1,000 h.p. motor will be on the 2-36-17 frame, the 1,250 h.p. on the 2-36-21 frame and the 2,000 h.p. on the 2-36-27 frame.

The approximate overall dimensions of these motors will be as follows:

This information will give you a rough idea as to the space requirements for the machine in question. We expect to have more complete information in the mail Monday morning relative to outline drawings, estimated prices, weights and delivery, together with the size of bearings and the critical speeds on all three ratings.

The motors will have the general construction as shown in figures 1, 4, 7 and 9 of Descriptive Leaflet 20391-A, copies of which are attached. Forced feed lubrication will be required on machines of these ratings and I presume that the blower will also require forced feed lubrication. We can either provide a small oil pump on the end of the motor shaft for lubrication of the motor bearings or lubrication can be provided by the fan manufacturer.

                          Mr. Nikola Tesla,
                          New York, N. Y.

                          My dear Mr. Tesla

We are taking steps to accumulate information regarding our Company's early history and achievements. Much of this, of course, is well known and is covered in various publications. We, however, desire to secure from individuals an account of the part they had in the Company's activities, either in engineering developments, in notable installations, or of other incidents which they recall and deem of significance and interest. Obviously, the inclusion of dates and of the names of those connected with incidents will be of particular interest. References to published papers by you or by others, describing the things in which you were most interested, are also needed.

This letter may seem a little general and indefinite, but you will catch its spirit. A collection of personal contributions from a large number of persons will bring together much material that is now unknown and will make a valuable collection of historical information which it is proposed to classify and index and keep as a permanent record of the Company.

Our Company has made many significant contributions to the electrical industry. Many of these have been due to the efforts of particular individuals, and their own stories of what was done will be a fine contribution to the history of the Company, now just reaching its fiftieth year.

Your advice along the above lines will be deeply appreciated.

                          Very truly yours,

                          H. W. Cope
                          Assistant to Vice President.

As an aid to accommodating the Institute, you have graciously consented to have your photograph taken beside the original Tesla split-phase motor which is at present located in Mr. Victor s> Beam's office at 150 Broadway, New York, but we would be glad to have this done either here or at some other place which would be more convenient to you and at whatever time and date you may name.

In the coming Trans-Mississipi International Exposition we have taken a large and prominent space and will give special prominence to a Tesla exhibit. We will have polyphase generators and motors, and desire to add to the interest of the exhibit by placing the early Tesla apparatus. A large exhibit of this was made at the World's Fair which was then sent to you in New York. It is possible that this may have been lost in your fire, though perchance it may have escaped and is now available. We request that you will let us have for exhibit as much material as is practicable. Let us know with regard to the matter at an early day as the Exposition opens very soon.

                              Very truly yours,

We appreciate your letter of October thirtieth to Mr. Robertson, outlining your recent investigation of the “art of producing terrestrial motion at distance.” I have referred it to our Research engineers who are considering the possible advantages of this mechanical method of transmitting signals as compared to wire and radio communication.

You have presented this subject in a very interesting manner and I want to thank you for referring it to us.

                                Gentlemen:

Permit me to remind you that recently I approached you with a specific proposal which I explained fully to your engineers. Their attitude in the matter caused me a painful surprise. Some money was necessary but they would not even recommend an advance for compensating my personal services or for the construction of my device. What interested me most was to give an exhibition of rotating field phenomena on a large scale. I had found that with a small field ring and only 100 horse power applied, delicate devices would spin in a radius of twenty feet around the ring, and with a large ring and ample power supply the phenomena could have been exhibited at great distance.

It would have been a triumph for the Westinghouse Company. But this avenue being closed, I ...

... I got in touch with a concern which had three scientists of world repute on their staff. When I gave them the same information they said at once that the plan was rational and expressed the desire to investigate it. As a business basis they paid me twenty-five thousand dollars and promised to see me again in a couple of months. On returning they reported that their tests had proved satisfactory and that they were ready to go ahead. This meant much money for me, but I had devoted years to raising poultry which involves several billions of dollars annually. The artificially raised poultry is unfit for the human stomach. The eggs are leathery and the meat is saturated with oils owing to which the body can not assimilate the proteins. With the help of a very able analytical chemist I have prepared a compound which I have named “Factor Auctus”, signifying “Creator of Growth” which is given daily in measured quantity to the fowls and pigeons separate from their food, and yields wonderful results. You will be grateful to me when you get the delicious eggs and meat obtained by this revolutionary process.

                                Believe me,

                                Yours very truly,
