        I cannot enter into a deeper study of this subject as the Grippe still bothers me and interferes with concentration. It would have been preferable to avoid mathematical formulas but it was indispensable to disprove the erroneous ideas and support my arguments.

              Dear Mr. Tesla:

              I thank you for inquiring about me. My trouble is not muscular strain as you surmised. It has been diagnose as sciatic neuritis and affect my left leg from hip to toes. I am fairly comfortable while lying down but sitting up or walking cause intense pain. Several injections of some substances have given me a slight relief. I am informed that diathermic treatment by high frequencies currents is very effective in alleviating this ailment. As soon as I begin moving about I shall go where such treatment is available and have it applied. This diathermy seems to be a new development in this treatment of diseases. In this connection a “Tesla Apparatus” would be a big seller. I envisions that it would be easy for you to design a portable outlet, one that physicians could carry around to treat patients. That ought to cheapen the cost of treatment, and then people like me would not have to worry so much about the expense.

              Your subpoena dated March 1, 1935, reference File G, relating to the Tesla Company, Inc., and addressed to my son George at 4 Lawrence Avenue, Mamaroneck, N.Y., has been handed to me, as I was at one time Secretary of that Company. I beg to be excused from appearing on March 7th as I have been confined to my bed for the passed three weeks by illness.

              I have no books or records of Tesla Company in my possession. My impression was that this corporation went out of existence years ago. It never did any business except collecting small royalties on one of the patents it owned, and I believe that all these patents expired long ago. Mr. Nikola Tesla, Hotel New Yorker, New York City, who was the founder and President of the Company, might give you more information.

                Dear Mr. Tesla:

                A few facts regarding geophysical exploration, which have come to my knowledge and to which I referred in a recent telephone conversation, are as follow:

                Texaco Development Corporation, a subsidiary of The Texas Company, has acquired the patent rights of Harvey C. Hayes, Ludger Mintrop, Burton McCollum and others, covering methods of geophysical exploration, and this Company brought suit against the Sun Oil Company for infringement of the patents. As all producing oil companies have for some time been using methods of exploration such as are covered by these patents, which involve the use of explosives for the discovery of subterranean domes and oil deposits, twenty-eight other oil companies voluntarily joined the Sun Oil Company in defending this suit and defraying the expenses thereof. However, the suit was never brought to trial, as the oil companies seem to have come to the conclusion that the patents in question are fundamental in this art, and therefore, since early this year, they are all acquiring license from Texaco Exploration Corporation. The license fee charged for what they call “One Seismographic Party” which permits the licensee to use one outfit, is $2,000.00 a year, and there are graduated reduced charges per outfit for licensees using more than one unit. An unlimited license is granted for $125,000.00. This does not mean that the Texaco Exploration Corporation supplies any instruments, the licensee merely acquires the right to use instruments provided at his own cost.

                The address of the Sun Oil Company is: 1608 Walnut Street, Philadelphia, Pa., and the name of its President is J. H. Pew.

                                Dear Mr. Tesla:

                                In answer to your telegram of yesterday I have just wired you that Bernstein will take care of the Foster action and that I have agreed to pay him $75.00 on June 4th. He specifies that this will not cover his services in the event that the case should have to go to court, It was hard work to get him down to this figure, but it was worth while, and I think he is well paid at that.

                                Yesterday I called on Mr. Foster in reference to the new action against Lowenstein. As I have telegraphed you, he will require figures and exact data for this purpose, but he says he cannot see how such an action would aid you in any way at the present time. On this occasion I asked Mr. Foster if he had thought over the matter of withdrawing his own suit. He said that his suit was not going to trouble you, as it would not come up for probably a year or so, and he merely wished to get it on the calendar in case a settlement should not have been made in the meantime. From this it seems to me now, that he must have become frightened for his own interests when he saw danger of your losing the De Lavergne and other cases.

                                Dear Mr. Tesla:

                                I received your letter of May 24th, and appreciate that you are between two fires – New York and Chicago both claiming you.

                                On Monday I telegraphed you that Mr. Foster has been able to obtain a short delay in the De Lavergne and Lowenstein cases, and adjournment from day to day until June 3rd having been granted by the Court. Yesterday I sent you Mr. Foster's letter holding out the hope of further postponement on another affidavit from you. If this delay is secured, it will affect both cases of course. If you make an arrangement with De Lavergne through the Cramps, there is still the Lowenstein case to be taken care of. Can I do anything in this respect?

                                Mr. Bernstein told me yesterday that he had obtained only ten days delay in the Foster case; I understood that he had been given twenty days. In securing this postponement, he says, he had to promise that he would not amend his answer, and he thinks that therefore a general denial of the charges should not be made, as some service may have been rendered to Tesla Company, Inc. He told me that he would telegraph you. Personally I know of no services by Foster to Tesla Company, inc., and am ready to sign a complete denial, if answer has to be made, I have not yet approached Foster again on the subject of withdrawing his complaint; it ought to be possible to come to an amicable arrangement with him. The ten days' delay will expire June 6th.
